SJ0001 Bill Summary Bill No.: SJ0001 Drafter: DRN LSO No.: 06LSO-0286 Effective Date: Enrolled Act No.: SEJR0001 Chapter No.: Prime Sponsor: Senator Coe Catch Title: School finance-recapture limitation. Subject: Constitutional provision for equalization of school district tax revenues through recapture of excess. Summary/Major Elements: Current constitutional provisions limit the amount of school district tax revenues which may be recaptured by the state and redistributed to school districts through the school foundation program. The constitutional limitation is at 75% of the excess (a separate computation based upon the districts assessed valuation per ADM compared to the statewide average). The proposed constitutional amendment eliminates this limitation, which would allow all "excess" to be recaptured and redistributed to school districts. The proposition will be submitted to the electorate at the November 2006 general election.
WORKING DRAFT ORIGINAL SENATE JOINT RESOLUTION NO. 0001 ENROLLED JOINT RESOLUTION NO. 1, SENATE FIFTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING 2006 BUDGET SESSION A JOINT RESOLUTION to amend the Wyoming Constitution; relating to the recapture of excess revenues for the support of public schools. BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING , two-thirds of all the members of the two houses, voting separately, concurring therein: Section 1. The following proposal to amend Wyoming Constitution, Article 15, Section 17 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election: Article 15, Section 17. County levy for support and maintenance of public schools. There shall be levied each year in each county of the state a tax of not to exceed six (6) mills on the dollar of the assessed valuation of the property in each county for the support and maintenance of the public schools. This tax shall be collected by the county treasurer and disbursed among the school districts within the county as the legislature shall provide. The legislature may authorize boards of trustees of school districts to levy a special tax on the property of the district. The legislature may also provide for the distribution among one (1) or more school districts of not more than three-fourths of any revenue from the special school district property tax in excess of a state average yield, which shall be calculated each year, per average daily membership. Section 2. The Secretary of State shall endorse the following statement on the proposed amendment: The Wyoming Supreme Court has held that school funding must be equalized among all school districts in the state. The adoption of this amendment would repeal the current limitation on the amount of property tax revenues that may be redistributed by the state through the School Foundation Program Account from school districts with greater property tax revenues to other school districts in the state.
