AN ACT relating to community college districts; requiring the Wyoming community college commission to develop recommendations on the organization of the state into community college districts; specifying criteria; imposing reporting requirements; and providing for an effective date.

301.

Community college district to be body corporate; name.

(a)

Each community college district which is formed under this act is a body corporate by the name and style of ".... Community College District, State of
Wyoming
", the blank space to contain the chosen name of the district, and in that name the district may hold property and be a party to suits and contracts.

(b)

Effective July 1, 2008, the state shall be divided into community college districts in accordance with the statewide plan submitted by the Wyoming community college commission and enacted by the 2008 Wyoming legislature.

(a)

The Wyoming community college commission shall in consultation with the established seven (7) community college districts, develop a plan for the organization of the entire state into community college districts, under which:

(i)

The entire state is divided into community college districts;

(ii)

All territory within each proposed district is contiguous;

(iii)

Each proposed district expands upon districts established before July 1, 2008, and approved by the commission under W.S. 21
‑

‑
202(d);

(iv)

Each proposed district contains a community college existing prior to this date and offering certificate and degree programs approved by the commission under W.S. 21
‑
18
‑
202(d);

(v)

The territory within each proposed district is divided into trustee residence areas such that representation is provided to every portion of any county within the proposed district and the total deviation in the population between the areas with the greatest and least population does not, to the extent practicable, exceed ten percent (10%);

(vi)

To the extent practicable, consideration is given to the per capita assessed valuation of the area within the proposed district to the state as a whole;

(vii)

Consideration is also given to the required number of mills a district must levy for the general support and operation of the district to qualify for state funding under W.S. 21
‑

‑
205(a)(ii), provided the required levy shall not exceed the four (4) mills authorized under W.S. 21
‑
18
‑
304(a)(vii).

(b)

The district organization plan developed under subsection (a) of this section shall be presented to the joint education interim committee and the joint appropriations
interim
committee not later than September 1, 2007. Based upon the report, the joint education interim committee shall develop recommendations together with necessary enabling legislation in sufficient time for consideration by the

legislature in the 2008 budget session.

This act is effective immediately upon co

pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit

tion.
