Summary/Major Elements: The act requires the game and fish department to annually prepare a report of licenses sold or issued in the previous year under statutes requiring free or reduced prices be charged for those licenses. The report will be submitted to the state auditor with a request for payment for the difference between the amount received by the department and the cost of a full price adult license corresponding with each type of license sold. The act requires the department to submit a budget request to fund the program in the future. Appropriates fund to the game and fish department from the general fund to replace lost revenues. Comments: Final action on this bill was not taken at the time this summary was prepared. WORKING DRAFT ORIGINAL HOUSE BILL NO. 0052 ENROLLED ACT NO. 107, HOUSE OF REPRESENTATIVES FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to game and fish; creating a free and reduced price license revenue recoupment program; providing for recoupment of license revenues lost due to statutorily designated free and reduced priced hunting and fishing licenses; providing for reports; providing an appropriation; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 23 ‑ 1 ‑ 504 is created to read: 23 ‑ 1 ‑ 504. Free and reduced price license revenue recoupment program. (a) Not later than July 31, 2007, and not later than July 31 of each subsequent year thereafter, the chief fiscal officer of the game and fish department shall prepare and certify a report of licenses sold or issued in the previous calendar year under the following statutes: (i) W.S. 23 ‑ 2 ‑ 201(f) and (g); (ii) W.S. 23 ‑ 2 ‑ 101(j)(xi), (xvi), (xvii), (xx), (xxi), (xxxii) and (xxxiii); (iii) W.S. 23 ‑ 2 ‑ 301(c)(xiii); (iv) W.S. 23 ‑ 1 ‑ 705(a), (d) and (e); and (v) W.S. 23 ‑ 2 ‑ 207(a). (b) The chief fiscal officer of the game and fish department shall submit to the state auditor the report created under subsection (a) of this section with a payment request for the number of licenses of each type sold or issued multiplied by the difference between the amount received by the department for that license and the cost of a full price adult license corresponding with each type of license sold or issued. (c) Upon receipt of the report and payment request, the state auditor shall transfer to the game and fish fund the amount claimed on the payment request from funds appropriated for this program to the extent available. (d) The game and fish commission shall prepare a biennial budget request prior to each budget session of the legislature for the purpose of funding the free and reduced price license revenue recoupment program and shall submit the request to the governor pursuant to W.S. 9 ‑ 2 ‑ 1010 through 9 ‑ 2 ‑ 1013. Section 2. There is appropriated to the state auditor one million one hundred thousand dollars ($1,100,000.00) from the general fund for the period beginning July 1, 2007 and ending June 30, 2008. Funds appropriated under this section shall only be expended for the purpose of funding the free and reduced price license revenue recoupment program and shall not be expended for any other purpose. Section 3. This act is effective July 1, 2007.
