Hazing prohibited; definition; penalty.

(a)

No person shall intentionally haze or conspire to haze any member, potential member or person pledged to be a member of any organization in a school, college, university or other educational institution in this state, as a condition or precondition of attaining membership in the organization or of attaining any office or status therein.

(b)

As used in this section, "haze" means to subject a person to bodily danger or bodily injury or a likelihood of bodily danger or bodily injury, or to require, encourage, authorize or permit that the person be subjected to bodily danger or bodily injury.

(c)

Any person who intentionally hazes another person is guilty of a:

(i)

Misdemeanor if the act results in bodily injury to another, punishable by imprisonment for not more than six (6) months, a fine of not more than seven hundred fifty dollars ($750.00), or both;

(ii)

Felony if the act results in serious bodily injury or death to another, punishable by imprisonment for not more than ten (10) years, a fine of not more than ten thousand dollars ($10,000.00), or both.

Section 2.
This act is effective July 1, 2007.
