WORKING DRAFT 2007 STATE OF WYOMING 07LSO-0181 HOUSE BILL NO. HB0106 School bus seat belts. Sponsored by: Representative(s) Davison, Martin, McOmie and Thompson and Senator(s) Sessions A BILL for AN ACT relating to motor vehicles; requiring seat belts in school buses as specified; amending related provision and repealing conflicting provision; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 31 ‑ 5 ‑ 1401(a)(ii) and by creating a new paragraph (vii) and 31 ‑ 5 ‑ 1402(a) are amended to read: 31 ‑ 5 ‑ 1401. Definitions. (a) As used in this act: (ii) "Passenger vehicle" means vehicle which is self-propelled and designed to carry eleven (11) persons or less and primarily used to transport persons, including pickup trucks but excluding emergency vehicles, motorcycles and buses that are not school buses ; (vii) "School bus" means a motor vehicle that is sold, or introduced in interstate commerce, for purposes that include carrying ten (10) or more students to and from school or related events, but does not include a bus designed and sold for operation as a common carrier in urban transportation, and is used to transport children . 31 ‑ 5 ‑ 1402. Safety belts required to be used; exceptions; reduction in fine. (a) Each driver and passenger of a motor passenger vehicle or school bus operated in this state shall wear, and each driver of a motor passenger vehicle or school bus shall require that a passenger under twelve (12) years of age shall wear, a properly adjusted and fastened safety belt when the motor vehicle is in motion on public streets and highways. Section 2. W.S. 31 ‑ 5 ‑ 1302(a)(v)(B) is repealed. Section 3. This act is effective July 1, 2007. (END) 1 HB0106
