Summary/Major Elements:

Under current law, proceedings for involuntary hospitalization of
persons with mental illnesses are commenced only in the county where the person
is initially detained and the Wyoming State Hospital shall serve as the
hospital of last resort to receive patients when no designated hospital or
other treatment facility is readily available.

This bill:

Allows involuntary commitment proceedings to begin in a county
where a designated hospital is located if there is a written agreement between
the county of residence and the designated hospital specifying that the county
of residence shall be responsible for costs of treatment that are not covered
by the state;

Eliminates the provision that the Wyoming State Hospital is the hospital of last resort.

Be It Enacted by the Legislature of the State of Wyoming:

Involuntary hospitalization proceedings.

(a)

Proceedings for the involuntary hospitalization of a person may be commenced by the filing of a written application with the court in the county in which the person is initially detained.
Proceedings may also be initiated in the county in which there is a designated hospital if there is a written agreement executed by the county in which the person resides and the designated hospital stating that the county in which the person resides will be responsible for costs of treatment under W.S. 25

112(e) that are not covered by the state.
The application shall be accompanied by either:

(j)

If, upon completion of the hearing and consideration of the record, the court or the jury finds by clear and convincing evidence that the proposed patient is mentally ill the court shall consider the least restrictive and most therapeutic alternatives
, and the state hospital shall serve as a hospital of last resort to receive patients if no designated hospital or other licensed treatment facility is readily available,
