Catch Title: Electronic stalking. Subject: Clarifies that harassment includes lewd or obscene statements or images, for purposes of the crime of stalking. Summary/Major Elements: Under current law, the definition of "harass", for purposes of the crime of stalking, includes verbal or written threats, vandalism or nonconsensual physical contact, directed at a specific person or the person's family, which the defendant knew or should have known would cause a reasonable person to suffer substantial emotional distress, and which does in fact seriously alarm the person toward whom it is directed. This act amends the definition of "harass" to include lewd or obscene statements or images .
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0137 ENROLLED ACT NO. 114, HOUSE OF REPRESENTATIVES FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to crimes and offenses; clarifying that harassment includes obscene statements or images for purposes of the crime of stalking; amending a definition; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 6 ‑ 2 ‑ 506(a)(ii) is amended to read: 6 ‑ 2 ‑ 506. Stalking; penalty. (a) As used in this section: (ii) "Harass" means to engage in a course of conduct, including but not limited to verbal threats, written threats, lewd or obscene statements or images, vandalism or nonconsensual physical contact, directed at a specific person or the family of a specific person, which the defendant knew or should have known would cause a reasonable person to suffer substantial emotional distress, and which does in fact seriously alarm the person toward whom it is directed. Section 2. This act is effective July 1, 2007.
