AN ACT relating to administration of the government; creating the capitol complex energy efficiency program; providing for the use of energy efficient measures in state buildings as specified; providing reporting requirements; providing an appropriation; providing for a position; and providing for an effective date.

Short title.

This act may be cited as the "Capitol Complex Energy Efficiency Program".

Definitions.

(a)

As used in this act:

(i)

"Capitol complex building" means any building, structure, or other improvement that is constructed on property owned by the state, any department of the state or its divisions, commissions, institutions or agencies within eight (8) city blocks of the capitol building. "Capitol complex building" does not include:

(A)

An unoccupied structure that is a component of the state highway system; or

(B)

A privately owned structure that is located on property owned by the state, its divisions, commissions, institutions or agencies.

(ii)

"Cost" means the expenses related to planning, design, construction and installation of energy efficiency measures and any administrative expenses of the division incurred in the performance of its duties under the capitol complex energy efficiency program;

(iii)

"Division" means the general services division of the department of administration and information;

(iv)

"Energy efficiency measures" means actions taken or initiated by a state agency that reduce the state agency's energy use, increase the state agency's energy efficiency, reduce source energy consumption, reduce water consumption or lower the costs of energy or water to the state agency;

(v)

"Manager" means the energy efficiency program manager within the division.

Capitol complex building efficiency program.

(a)

Each state agency occupying a capitol complex building shall:

(i)

Submit to the division, on forms provided by the division, a list of facilities in the capitol complex area operated by that agency that have a potential for energy savings, based on age, energy use, function and condition of the building;

(ii)

Designate a staff member that is responsible for coordinating energy efficiency efforts within the agency;

(iii)

Provide energy consumption and costs information to the division on a monthly basis;

(iv)

Develop strategies for improving energy efficiency and reducing energy costs by utilizing renewable or alternative energy resources when practicable and procuring
and using energy efficient products when practicable; and

(v)

Provide the division with information regarding the agency's energy efficiency and reduction strategies as well as the net effect of the strategies on energy consumption and costs.

(b)

Based on the information submitted to the division pursuant to paragraph (a)(i) of this section, the division shall select certain facilities for furt
her
energy analysis to identify the technical and financial feasibility of making energy conservation improvements to the facilities.

Reporting requirements.

(a)

The division, through its energy efficiency program manager and as outlined in W.S. 9

‑
1040 shall report to the governor and joint appropriations interim committee of the legislature and state building commission on or before October 15 of each year.

(b)

Each facility manager of a capitol complex building shall report to the division on or before June 15 of each year and provide proof of the efforts made to conserve energy at the building as evidenced by:

(i)

Education programs and incentives for staff participation;

(ii)

Energy usage records showing reductions and related weather information;

(iii)

Records of recycled product use and the estimated cost-savings realized;

(iv)

Replacement of equipment with higher efficiency ratings and the estimated cost-savings realized;

(v)

Landscaping modifications for energy use reduction; or

(vi)

Comparable measurable efforts.

Energy consumption council.

An energy consumption council shall meet periodically with the division to assist the division in prioritizing opportunities to reduce energy consumption in capitol complex buildings. The council shall consist of five (5) to seven (7) members. The council shall advocate to state agencies methods to reduce energy consumption. The members shall be comprised of individuals who are the designated staff members from their respective agencies who are responsible for coordinating their agency's efforts regarding energy efficiency. The members of the council shall be appointed by the governor and shall receive no additional compensation for serving as a member of the council.

Duties of the general services division of the department of administration and information.

(a)

The division may:

(i)

Analyze state utility data to identify high potential energy efficiency opportunities in capitol complex buildings;

(ii)

Perform comprehensive energy analysis on capitol complex buildings, structures and facilities;

(iii)

Train facility maintenance staff in energy saving techniques and maintenance of energy improvements, and monitor energy conservation efforts by state agencies located in capitol complex buildings.

(b)

The division shall employ an energy efficiency program manager to coordinate the duties of the division under this act. The manager shall compile monthly reports showing efforts and effects of efforts to reduce energy consumption in capitol complex buildings.

(c)

The department of administration and i
nformation shall have authority to promulgate any rules and regulations necessary to implement and administer this act.

General services division.

(b)

For the purpose of this subsection

the term "agencies" does
not
include the
University
of
Wyoming
, community college districts, or school districts. It does not include the department of transportation except as to paragraphs (xi), (xii) and (xiii) of this subsection. The department through the general services division shall:

(xxiii)

Administer the capitol complex building energy efficiency program pursuant to the duties specified in W.S. 9

‑
1040.

Section 3.

(a)

Ninety thousand dollars ($90,000.00)
is appropriated from the general fund to the department of administration and information for the purpose of this act for the fiscal biennium ending June 30, 2008.

(b)

One (1) additional full-time position is authorized for the division of administration and information to implement and coordinate the
capitol complex
building energy efficiency program. This position is time limited and shall be terminated on June 30, 2010.

Section 4.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
