Subject: Local match requirement for Department of Health expenditures on developmental preschool services. Summary/Major Elements: Current law at W.S. 21-2-706 authorizes the Department of Health to make expenditures, based upon a specified formula without any local match requirement, to acquire services of special educators, occupational therapists, physical therapists and speech-language therapists from developmental preschool service providers; The Community Human Services Act at W.S. 35-1-622(b) requires a 10% local match whenever the Department of Health purchases human services, including developmental disabilities services, from any community board or public agency; This act amends both of the above laws to provide that a 3% local match is required for developmental preschool contract expenditures, whether obtained from a private provider, community board or public agency.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0177 ENROLLED ACT NO. 71, HOUSE OF REPRESENTATIVES FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to the department of health; requiring local matching funds for developmental preschool services as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 21 ‑ 2 ‑ 706(a) by creating a new paragraph (iv) and 35 ‑ 1 ‑ 622(b) are amended to read: 21 ‑ 2 ‑ 706. Developmental preschool funding. (a) Expenditures by the division for developmental preschool services shall be subject to the following: (iv) Three percent (3%) matching local funds shall be required in contracts with any developmental preschool service provider. 35 ‑ 1 ‑ 622. Department; budget requests; purchase of service contracts; local match. (b) The department shall contract with community boards, public agencies and private agencies to purchase only those services funded by the legislature on a statewide basis. Funds contracted for under this act , other than funds for developmental preschool services, shall not exceed ninety percent (90%) of the total nonfederal expenditures for human services programs by any community board or public agency. For developmental preschool services the local match requirement shall be three percent (3%). Section 2. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion.
