A BILL

for

AN ACT relating to family violence and sexual assault; specifying that communications between victims of domestic violence or sexual assault and family violence or sexual assault advocates through interpreters and translators are confidential; providing exceptions; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

116(a) by creating a new paragraph (vii) and (b) by creating a new paragraph (iii) is amended to read:

Confidential communications among family violence and sexual assault advocate, interpreters, translators and victim.

(a)

As used in this section:

(vii)

"Interpreter or translator" means a person who facilitates dialogue between the advocate and the victim who use different languages.

(b)

210, a person exempted from testifying under the provisions of W.S. 1

116 shall not be examined as a witness in any civil, criminal, legislative or administrative proceeding concerning the following communications and information:

(iii)

An interpreter or translator shall not testify concerning a confidential communication made between the victim and the advocate in the course of that relationship, except the interpreter or translator may be compelled to testify as provided in paragraph (b)(i):

(A)

About the accuracy of the translation, if the accuracy of the translation is challenged.

Section 2.

This act is effective July 1, 2007.
