Subject: Providing for the sale of state land in Uinta County to Unita County. Summary/Major Elements: This act authorizes and directs the board of land commissioners to transfer the state's interests in the surface estate of a number of parcels of state owned "nontrust" land to Unita County. The transfer is to be by sale at fair market value as determined by an appraisal. The office of state lands and investments is directed to have a survey of the land and the LSO is directed to correct any incorrect legal description of the land to conform to the survey and the stated legislative intent. Comments: Report Required the office of state lands is to conduct a survey in order for the legal description provided in the act to be conformed by the LSO, if necessary.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0200 ENROLLED ACT NO. 60, HOUSE OF REPRESENTATIVES FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to state lands; directing the sale of the surface estate interest in certain state lands to Uinta County; providing for disposition of proceeds ; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 36 ‑ 8 ‑ 1202 is created to read: 36 ‑ 8 ‑ 1202. Sale of land to Uinta County . (b) The board of land commissioners is authorized and directed to convey, subject to section 2 of this act, its right, title and interest, in the surface estate of the following described parcel of land to Uinta County: All that part of said Section 23 lying north of the northerly right-of-way line of Interstate Highway 80 and west of the westerly right-of-way line of Uinta County Road No. 109; less and except those lands described in that Warranty Deed recorded in Book 787 on Page 283 of the Uinta County Records; less and except those lands described in that Warranty Deed recorded in Book 673 on Page 241 of the Uinta County Records; less and except those lands described in that Quitclaim deed recorded in Book 541 on Page 46 of the Uinta County Records, said tract containing 47 acres and subject to any rights-of-way or other easements as granted or reserved by instruments of record or as now exist thereon. (d) The conveyances authorized in this section shall be by sale at fair market value as determined by an appraisal. Section 2. It is the intent of this bill to convey the state owned, nontrust land in sections 23 and 26 of Township 15 North, Range 120 West of the 6 th P.M. described above. After passage of the bill, the office of state lands and investments shall prepare a fair market value appraisal of the identified land and shall commission a survey of the property by a licensed Wyoming surveyor in order to establish the legal descriptions of the land being conveyed by this bill. The office of state lands and investments shall order a title insurance policy covering the surface estate and a mineral title search of all interests in the mineral estate in order to guarantee acceptable title of the lands being transferred by this act. The office of state lands and investments shall prepare all deeds and documents necessary to complete the transaction. All costs associated with the land appraisal, survey, title insurance and closing shall be paid by Uinta County . The legislative service office is directed to correct the legal descriptions contained in section 1 of this act to conform to the legal description established by the survey. Section 3. Any payments made to the state by Uinta County relating to the land conveyance under this section shall be deposited in the state hospital permanent land fund. Section 4. This act is effective July 1, 2007.
