WORKING DRAFT 2007 STATE OF WYOMING 07LSO-0603 HOUSE BILL NO. HB0245 State funds-investment in Sudan . Sponsored by: Representative(s) Brechtel and Warren A BILL for AN ACT relating to investment of state funds; providing that state funds shall not be invested in Sudan; providing exemptions; providing a sunset clause; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section l. W.S. 9 ‑ 4 ‑ 711 by creating new subsections (e) through (g) is amended to read: 9 ‑ 4 ‑ 711. Permissible investments of state funds. (e) Funds of the state of Wyoming shall not be invested in a security of, or an entity doing business in, Sudan . For the purposes of this subsection: (i) "Entity" means as defined in paragraph (d)(ii) of this section; (ii) "Security" means as defined in paragraph (d)(i) of this section; (iii) " Sudan " means the Republic of Sudan , a territory under the administration or control of Sudan , including but not limited to, the Darfur region or an individual, company or public agency in Khartoum , northern Sudan or the Nile river valley that supports the Republic of Sudan . (f) Subsection (e) of this section shall not apply to any of the following: (i) Investments in a company that is primarily engaged in supplying goods or services intended to relieve human suffering in Sudan ; (ii) Investments in a company that promotes health, education, journalistic or religious activities in or welfare in the western, eastern or southern regions of Sudan ; (iii) Investments in a United States company that is authorized by the federal government to have twenty-four ( 24 ) business operations in Sudan . (g) The prohibition contained in subsection (e) of this section shall remain in effect only until the governor certifies that one (1) of the following has occurred: (i) The government of Sudan halts the genocide in Darfur for twelve (12) months as determined by both the d epartment of s tate and the c ongress of the United States ; (ii) The United States revokes its current sanctions against Sudan . Section 2. This act is effective July 1, 2007. (END) 1 HB0245
