Subject: Payment due date for holders of surface water point source discharge permits. Summary/Major Elements: Changes the date surface water point source discharge elimination permit fees under the national pollutant discharge elimination system are due annually to the Department of Environmental Quality (DEQ) from July 1 to January 1. Provides that DEQ shall assess and collect the full annual fee on July 1, 2007 and shall collect of the annual fee on January 1, 2008 and the full fee annually thereafter. This change was made so that a discharge permit issued for a construction site would not have to be renewed during the height of the building season and to switch from the state fiscal year to a calendar year billing cycle. Comment: This summary should replace the summary included in supplemental packet 1.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0246 ENROLLED ACT NO. 105, HOUSE OF REPRESENTATIVES FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to environmental quality; amending the date on which the point source discharge permit fee is assessed; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 35 ‑ 11 ‑ 312(a) is amended to read: 35 ‑ 11 ‑ 312. Fees. (a) The department shall implement a surface water point source discharge permit fee system for each national pollutant discharge elimination system permit. On July 1 January 1 of each year, the department shall assess an annual permit fee of one hundred dollars ($100.00) for each national pollutant discharge elimination system permit and for each permit authorization held by any person under W.S. 35 ‑ 11 ‑ 301 during any portion of the preceding twelve (12) month period. The department shall prepare a biennium report on the fee system for review by the joint minerals, business and economic development interim committee by October 31 of the year prior to the Wyoming legislative budget session. Section 2. The department of environmental quality shall assess and collect the full annual fee on July 1, 2007 and shall assess and collect one-half (1/2) of the annual fee on January 1, 2008 and the full fee annually thereafter. Section 3. This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
