Use of false citizenship or resident alien documents, penalty.

(a)

Any person who uses false documents to conceal his true citizenship or resident alien status is guilty of a felony punishable by imprisonment for not more than five (5) years, a fine of not more than ten thousand dollars ($10,000.00), or both.

(b)

Any official or employee of the state of Wyoming or any political subdivision thereof who is presented with any document in connection with an application for any public benefit, including an application for a driver's license, and who has reasonable cause to believe that it is a false document in violation of subsection (a) of this section, is authorized to seize and retain the document. Upon seizure, the document shall be delivered to a law enforcement official having jurisdiction to investigate the violation as soon as reasonably possible. The official or employee shall be immune from any cause of action brought by any person or entity based upon the seizure.

Section 2.

This act is effective July 1, 2007.
