Catch Title: Real estate disclosure. Subject: Required disclosures of certain conditions on vacant land. Summary/Major Elements: Requires that every seller of vacant land provide to the buyer a property disclosure statement, including: o Whether the property is being offered as a unified estate and if the fee ownership of the mineral estate has been severed from the surface estate; o The availability of public utilities, water and sewer infrastructure and fire protection services; o The name of the entity that maintains the roads and the level of maintenance; and o The existence of any easements. A failure to provide a required property disclosure will not invalidate a property transfer, but willful or negligent violation of this section will render the seller liable for the amount of actual damages suffered by the buyer. WORKING DRAFT ORIGINAL HOUSE BILL NO. 0274 ENROLLED ACT NO. 124, HOUSE OF REPRESENTATIVES FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to real property; requiring sellers to provide a disclosure statement to prospective buyers as specified; and providing for an effective date. Be it Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 34 ‑ 1 ‑ 151 is created to read: 34 ‑ 1 ‑ 151. Property disclosure statement. (a) Except as provided in subsection (b) of this section, every seller of vacant land shall provide to any prospective buyer a property disclosure statement that includes, but is not limited to, the following information: (i) Whether the property is being offered as a unified estate; (ii) If fee ownership of the underlying mineral estate has in any way been severed in the chain of title from the surface estate; (iii) The availability and location of public utilities; (iv) The name of the entity that maintains the roads and the level of maintenance available; (v) The availability of water and sewer infrastructure; (vi) The availability of fire protection services; and (vii) The existence and location of any easements across the land known to the seller or recorded in the records of the county clerk. (b) A buyer may waive disclosure of the information required under subsection (a) of this section. (c) No transfer subject to this section shall be invalidated solely because of the failure to comply with the provisions of subsection (a) of this section. However, any person who willfully or negligently violates or fails to perform the duties prescribed by subsection (a) of this section shall be liable in the amount of actual damages suffered by the buyer. Section 2. This act is effective July 1, 2007.
