A BILL

for

AN ACT relating to insurance; providing for a study by the
Wyoming
healthcare commission of clauses in health insurance excluding coverage for claims related to the insured's participation in clinical trials; providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.
The
Wyoming
healthcare commission shall conduct a study of issues related to the exclusion from coverage, under health insurance policies or certificates of health maintenance organizations, of claims related to the insured's participation in a clinical trial of a new pharmaceutical drug or clinical procedure. The study shall seek to identify ways to authorize coverage of routine patient care costs associated with clinical trials while excluding coverage for the direct cost of the item or procedure being tested. The commission shall report the results of its study, with any recommended legislation, to the joint labor, health and social services interim committee by November 1, 2007.

Section 2.
There is appropriated to the
Wyoming
healthcare commission for the purposes of this act fifty thousand dollars ($50,000.00) from the general fund for the period beginning with the effective date of this act and ending December 31, 2007.

Section 3.
This act is effective immediately upon co
m
pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit

tion.
