Sponsored by: Representative(s) Esquibel, F. and Brown A BILL for AN ACT relating to driver's licenses; providing that a person operating a motor vehicle with an intermediate permit shall not use a cellular or satellite phone; providing definitions; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 31 ‑ 7 ‑ 102(a) by creating new paragraphs (xlvii) through (xlix) and by renumbering (xlvii) as (l) and 31 ‑ 7 ‑ 110(h) by creating a new paragraph (iii) are amended to read: 31 ‑ 7 ‑ 102. Definitions. (a) As used in this act: (xlvii) "Cellular telephone" means a mobile communication device that uses short ‑ wave analog or digital radio transmissions between the device and a nearby transmitter to permit wireless telephone communications to and from the user of the device within a specified area ; (xlviii) "Emergency response vehicle" means any ambulance, fire department, law enforcement or civil defense vehicle or other vehicle used primarily for emergency purposes; (xlix) "Satellite telephone" means a mobile communication device that transmits and receives radio signals to and from one (1) or more satellites in earth's orbit to permit wireless telephone communications to and from the user. "Satellite telephone" shall not include a citizen's band radio; (xlvii) (l) "This act" means W.S. 31 ‑ 7 ‑ 101 through 31 ‑ 7 ‑ 313. 31 ‑ 7 ‑ 110 . Instruction and temporary driver's permits. (h) A person operating a motor vehicle, other than a motorcycle, with an intermediate permit: (iii) Shall not use a cellular or satellite telephone. This section shall not apply to a person who is using the cellular or satellite telephone: (A) While the vehicle is lawfully parked; or (B) To contact an emergency response vehicle. Section 2. This act is effective July 1, 2007. (END) 1 HB0284
