AN ACT relating to youth; creating the legislative-executive youth advisory council; providing terms; specifying duties; providing administrative duties; and providing for an effective date.

Legislative-executive youth advisory council established; members; terms; duties.

(a)

There is created within the office of the superintendent of public instruction the youth advisory council. The advisory council shall consist of twenty-one (21) voting members appointed by the governor, who are aged twelve (12) to twenty-two (22) at the time of their appointment. The council shall also consist of six (6) ex officio members of which two (2) shall be members of the house of representatives appointed by the speaker of the house, two (2) shall be senators appointed by the president of the senate, one (1) shall be the governor's designee and
one
(1) shall be the designee of the superintendent of public instruction.

(b)

There shall be two (2) co-chairs selected from the voting members of the advisory council. One
(1)
co-chair shall be selected by the speaker of the house and the remaining co-chair shall be selected by a vote of the advisory council.

(c)

The governor may remove any voting member of the advisory council as provided in W.S. 9

(d)

Except for initial voting members, members shall serve a term of two (2) years, and if eligible, may be reappointed for a subsequent two (2) year term. Ten (10) of the initial members shall be appointed to one (1) year terms and the remaining initial members shall be appointed to two (2) year terms. Initial ex officio members shall serve a term of two (2) years. Vacancies on the advisory council shall be filled by appointment for the unexpired term.

(e)

Members of the advisory council who are not legislators shall not receive a salary but shall receive reimbursement for necessary travel and per diem expenses in the manner and amount provided for state employees under W.S. 9

103. Members of the task force who are legislators shall be paid salary, per diem and travel expenses as provided in W.S. 28

101 for their official duties as members of the task force.

(f)

The advisory council shall meet in person no more than four (4) times each year.

(g)

The advisory council shall:

(i)

Examine issues of importance to youth, including but not limited to education, employment, strategies to increase youth participation in government, safe environments for youth, substance abuse, emotional and physical health, foster care, poverty, homelessness and youth access to services on a statewide and municipal basis;

(ii)

Advise the governor and the superintendent of public education of issues facing the youth of this state and provide recommendations for addressing these issues;

(iii)

Advise the legislature on proposed and pending legislation, including state budget expenditures and policy matters relating to youth;

(iv)

Conduct periodic seminars for members of the legislature and the executive branch regarding leadership, government and the legislature; and

(v)

Report annually by December 1 to the legislature on its activities, including proposed legislation that implements recommendations of the council.

(h)

The superintendent of public instruction shall provide administration, coordination and facilitation assistance to the advisory council. The senate and house of representatives may provide policy and fiscal briefings and assistance with proposed legislation.

(j)

This section is repealed effective June 30, 2012.

($40,000.00) from the general fund for the purposes of this act for the fiscal period ending June 30, 2008. Of this amount, five thousand dollars ($5,000.00) is appropriated to the legislative service office to fund the salaries, per diem and travel expenses of the state legislative members of the advisory council pursuant to section 1 of this act. The remainder is appropriated to the office of the superintendent of public instruction to fund the meetings and activities of the advisory council as necessary to complete the duties assigned to the advisory council in section 1.

This act is effective
