Subject: Law enforcement interstate mutual aid agreements. Summary/Major Elements: The Law Enforcement Interstate Mutual Aid Act currently requires the governor's approval (either oral or written) before a Wyoming law enforcement agency may respond under a mutual aid agreement. This bill amends the Law Enforcement Interstate Mutual Aid Act to allow an agreement entered into under the Act to include specified emergencies for which parties under the agreement and the governor concur that law enforcement may respond without the governor's authorization. Comments: Final action on this bill was not taken at the time this summary was prepared. Should changes be made to the bill upon final passage an updated summary will be transmitted to all legislators.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0306 ENROLLED ACT NO. 106, HOUSE OF REPRESENTATIVES FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to law enforcement; providing that a mutual aid agreement may contain specific emergency events for which law enforcement may respond without the governor's approval; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 7 ‑ 3 ‑ 903(a) and 7 ‑ 3 ‑ 904 by creating a new subsection (b) are amended to read: 7 ‑ 3 ‑ 903. Authorization to enter agreement; general content; authority of law enforcement employee. (a) Any one (1) or more law enforcement agencies of this state may enter into a mutual aid agreement with any one (1) or more law enforcement agencies of an adjoining state or the United States to render assistance in the provision of the law enforcement or emergency services that the requesting party is authorized by law to perform. Except as authorized by W.S. 7 ‑ 3 ‑ 904(b), a ny agreement under this act shall be limited to providing assistance in an emergency or special event as determined by the governor. The governor shall have emergency procedures in place for immediate approval of any mutual aid agreement, which may include oral authorization by the governor, subject to subsequent written agreement as provided by this act. If required by applicable law, the agreement shall be authorized and approved by the governing body of each party to the agreement. 7 ‑ 3 ‑ 904. Detailed content of agreement. (b) The agreement may include specified emergency or special events for which the parties to the agreement and the governor concur that law enforcement may respond under the mutual aid agreement without the governor's authorization required under W.S. 7 ‑ 3 ‑ 903. Section 2. This act is effective July 1, 2007.
