Legislators-assumption of duties.

A BILL

for

A JOINT RESOLUTION proposing to amend the Wyoming Constitution to clarify the terms of office of legislators.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF
WYOMING
,
two-thirds of all the members of the two houses, voting separately, concurring therein:

Section 1.
The following proposal to amend Wyoming Constitution, Article 3, Section 5 and Article 6, Section 16 is proposed for submission to the electors of the State of
Wyoming
at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election:

Article 3, Section 5.

When members elected and terms begin.

Members of the senate and house of representatives shall be elected on the day provided by law for the general election of a member of congress, and their term of office shall begin on the first Monday of January thereafter
and continue until their successors are elected and duly qualified
.

Article 6, Section 16.

When officers to hold over; suspension of officers.

Every person holding any civil office under the state or any municipality therein shall, unless removed according to law, exercise the duties of such office until his successor is duly qualified, but this shall not apply to
members of the legislature, nor to
members of any board or assembly, two or more of whom are elected at the same time. The legislature may by law provide for suspending any officer in his functions, pending impeachment or prosecution for misconduct in office.

Section 2.
That the Secretary of State shall endorse the following statement on the proposed amendment:

This amendment will clarify that the terms of office of legislators begin on the first Monday of January following their election to office and continue until their successors are elected and duly qualified. This is similar to the term of office for the state elected officials including the governor, secretary of state, auditor, treasurer and superintendent of public instruction.
