Subject: Chemicals used for lethal injection Summary/Major Elements: Under current Wyoming law, a sentence of death is carried out by the injection of a "lethal quantity of an ultra-short-acting barbiturate in combination with a chemical paralytic agent." This bill brings Wyoming's statute into line with a number of other states by requiring that the execution protocol for intravenous injection be expanded to include "potassium chloride or other equally effective substances sufficient to cause death".
WORKING DRAFT ORIGINAL SENATE FILE NO. 0004 ENROLLED ACT NO. 8, SENATE FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to criminal procedure; modifying the method of execution by lethal injection as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 7 ‑ 13 ‑ 904(a) is amended to read: 7 ‑ 13 ‑ 904. Method of execution. (a) When sentence of death is imposed by the court in any criminal case, the punishment of death shall be executed by the administration of a continuous intravenous injection of a lethal quantity of an ultra - short - acting barbiturate in combination with a chemical paralytic agent and potassium chloride or other equally effective substances sufficient to cause death , until death is pronounced by a licensed physician according to accepted standards of medical practice. The sentence of death shall be executed within the time prescribed by law, unless, for cause shown, the court or governor extends the time. Administration of the injection does not constitute the practice of medicine. Section 2. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion.
