Summary/Major Elements: This act: Authorizes issuance of a new vehicle title, following the death of one of the vehicle's joint tenants with right of survivorship, in the name(s) of the surviving joint tenant(s) upon presentation of the death certificate to the county clerk; Provides that no sales or use tax shall be due upon transfer to the surviving joint tenant or tenants; Authorizes issuance of a new vehicle title, following the death of one of the vehicle's joint tenants with right of survivorship, in the name of a transferee who was not a joint tenant upon presentation of the death certificate to the county clerk; Provides that any applicable sales or use tax shall be due upon transfer to a transferee who was not a surviving joint tenant.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0031 ENROLLED ACT NO. 60, SENATE FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to motor vehicles; providing for issuance of a new certificate of title following the death of a joint owner as specified; providing for transfer of a vehicle by a surviving joint owner; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 31 ‑ 2 ‑ 104 by creating new subsections (j) and (k) is amended to read: 31 ‑ 2 ‑ 104. Transfer of ownership. (j) If a vehicle is held by two (2) or more persons as joint tenants with right of survivorship clearly stated on the certificate of title , following the death of one (1) of the joint owners a surviving owner may apply to a county clerk for a new certificate of title in the name of the survivor or, if more than one (1) owner survives, jointly in the names of the survivors. The application for a new certificate of title shall be accompanied by a certified copy of the death certificate of the deceased owner. The county clerk shall issue the new certificate of title as provided in W.S. 31 ‑ 2 ‑ 103(d), except that no sales or use tax shall be due when obtaining a certificate of title pursuant to this subsection. (k) Notwithstanding the provisions of subsection (j) of this section, the surviving owner or owners of a vehicle held by joint tenants with the right of survivorship may transfer ownership without first obtaining a title in the name of the surviving owner or owners by complying with the requirements of subsection (a) of this section and providing the transferee with a certified copy of the death certificate of the deceased owner. Any applicable sales or use tax shall be paid pursuant to W.S. 39 ‑ 15 ‑ 107(b) or 39 ‑ 16 ‑ 107(b). Section 2. This act is effective July 1, 2007.
