Summary/Major Elements: Current law establishes a 20 MPH speed limit when passing a school building, school grounds or school crossing. This act: Provides that the school speed limit also applies in any area in the vicinity of a school that is designated by an official traffic control device as a school zone with a reduced speed limit; Increases the minimum fines for exceeding a school speed limit by more than 10 MPH from $100 to $200 for a first offense and from $200 to $400 for subsequent offenses within one year.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0041 ENROLLED ACT NO. 70, SENATE FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to motor vehicles; providing for enforcement of speed limits in safety zones established in the vicinity of schools; amending penalties for passing stopped school buses and for speeding in school zones as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 31 ‑ 5 ‑ 301(b)(i) and 31 ‑ 5 ‑ 1201(e) are amended to read: 31 ‑ 5 ‑ 301. Maximum speed limits. (b) Except when a special hazard exists that requires lower speed for compliance with subsection (a) of this section, the limits specified in this subsection or established as otherwise authorized shall be maximum lawful speeds and no person shall drive a vehicle on a highway at a speed in excess of maximum limits: (i) Twenty (20) miles per hour when passing a school building, or the grounds thereof, within any other area or space in the vicinity of a school designated by an official traffic control device as a school zone with a reduced speed limit or a school crossing if appropriate signs giving notice of that a reduced speed limit are erected; 31 ‑ 5 ‑ 1201. Violation of provisions to constitute misdemeanor; penalties. (e) Any person convicted of a violation of W.S. 31 ‑ 5 ‑ 507(a) or convicted of exceeding the posted speed limit in a school zone as provided in W.S. 31 ‑ 5 ‑ 301(b)(i) by more than ten (10) miles per hour shall be fined not less than one hundred dollars ($100.00) two hundred dollars ($200.00) nor more than seven hundred fifty dollars ($750.00). Upon any subsequent conviction of either a violation of W.S. 31 ‑ 5 ‑ 507(a) or a conviction of exceeding the posted speed limit in a school zone as provided in W.S. 31-5-301(b)(i) by more than ten (10) miles per hour within one (1) year, a person shall be fined not less than two hundred dollars ($200.00) four hundred dollars ($400.00) nor more than one thousand dollars ($1,000.00). Section 2. This act is effective July 1, 2007.
