Courthouse security pilot projects.

A BILL

for

AN ACT relating to the Wyoming supreme court; authorizing the supreme court to establish pilot projects to reimburse law enforcement agencies for courthouse security as specified; providing procedures for implementation of the pilot projects; providing an appropriation; requiring a report; and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

For the period beginning with the effective date of this act and ending June 30, 2008, there is appropriated one million dollars ($1,000,000.00) from the general fund, or as much thereof as necessary, to the Wyoming supreme court to establish and administer not more than three (3) pilot projects in the state to reimburse law enforcement agencies providing security for court facilities within the pilot projects. The appropriation under this section shall be subject to the following:

(i)

The board of judicial policy and administration shall recommend to the supreme court:

(A)

Rules and regulations governing standards for the provision of security for court facilities within the pilot projects;

(B)

The amount of funding each pilot project authorized by this section shall be awarded;

(C)

The courts within the pilot projects which may be eligible for reimbursement for security provided by law enforcement agencies;

(D)

The additional training that may be necessary for courthouse security and the extent to which the training will be reimbursed; and

(E)

Levels of reimbursement to the law enforcement agencies selected to provide courthouse security within the pilot projects.

(ii)

The supreme court shall:

(A)

Require each court eligible for reimbursement under this section to enter into an agreement with the appropriate board of county commissioners and an appropriate law enforcement agency to provide courthouse security as identified in the agreement, including specifying any additional law enforcement training that may be necessary for courthouse security;

(B)

Distribute funds to the courts eligible for funding under this section to reimburse the law enforcement agencies in accordance with the agreements executed under subparagraph (A) of this paragraph.

(b)

The supreme court shall report no later than June 30, 2008 to the joint appropriations interim committee and the joint judiciary interim committee on the effectiveness and costs of implementing courthouse security under the pilot projects authorized by this section, including recommendations whether to continue or terminate the pilot projects, or to expand and enhance the courthouse security program to other court facilities not covered by the pilot projects authorized by this section.
