2007 GENERAL SESSION

AN ACT relating to the administration of government; creating a drug court steering committee to study administration of drug courts; specifying membership and duties; requiring reports; providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

There is created a drug court steering committee whose purpose shall be to help create a more uniform administration of drug courts in the state.

(b)

The committee shall be comprised of:

(i)

All members of the drug court panel created by W.S. 5

103;

(ii) Two (2) members of the
Wyoming
senate, appointed by the president of the senate. Not more than one (1) member shall be of the same political party. The president of the senate shall designate a cochairman of the committee;

(iii)

Two (2) members of the
Wyoming
house of representatives, appointed by the speaker of the house. Not more than one (1) member shall be of the same political party. The speaker of the house shall designate a cochairman of the committee;

(iv)

Three (3) judges appointed by the board of judicial policy and administration. In making appointments under this paragraph the board shall attempt to make appointments from municipal, circuit and district court judges who are and who are not currently participating in the drug court program;

(v)

One (1) county or prosecuting attorney, appointed by the
Wyoming
county and prosecuting attorneys
association
;

(vi)

One (1) member of the Wyoming state bar who practices criminal defense law, appointed by the state public defender; and

(vii)

A representative of the
University
of
Wyoming
's criminal justice department, appointed by the president of the university. This member shall serve as a nonvoting, ex-officio member.

(c)

The committee shall review and make recommendations regarding the following:

(i)

State level structural models for drug courts and the most appropriate model for
Wyoming
;

(ii)

Alternative adjudication procedures for drug courts, including the use of court commissioners, magistrates, administrative law judges and hearing officers;

(iii)

The progress and value of the department of health's substance abuse division's case management system and means for improvement;

(iv)

The state's funding model and its current and most appropriate connection to results in drug courts;

(v)

Collaboration between agencies and branches of government in the operation of drug courts;

(vi)

Drug court participation by county and the best means to increase drug court participation by counties not participating due to revenue issues;

(vii)

Performance measures, as developed by the committee, for evaluation on a statewide basis.

(d)

The committee shall report not later than August 1, 2007, and August 1, 2008 to the joint judiciary interim committee regarding its findings and recommendations. The committee shall terminate as of December 31, 2008.

(e)

Legislators serving on the committee shall be paid salary, per diem and travel expenses as provided in W.S. 28

101 for their official duties as members of the committee. Judges and any state agency personnel, including the
University
of
Wyoming
representative, serving on the committee shall receive per diem and travel expenses as provided in W.S. 9

102. State agency personnel shall be paid from their agency budget. Judges shall be paid from funds of the board of judicial policy and administration. Other nonlegislative members serving on the committee shall receive travel and per diem expenses incurred for their official duties as members of the committee in the same amount as legislators under W.S. 28

(f)

The committee shall be staffed by the department of health. State agencies, including the
University
of
Wyoming
, shall assist the committee as requested in conducting its duties under this act.

Section 2.

There is appropriated commencing with the effective date of this act through the fiscal year ending June 30, 2009, ten thousand dollars ($10,000.00) from the general fund to the legislative service office for compensation of legislative members serving on the drug court steering committee.

Section 3.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
