Summary/Major Elements:

Under current law, a person
convicted of causing serious bodily injury to another while driving
under the influence of alcohol or a controlled substance
is subject to a penalty of imprisonment for not less than 6 months nor more
than one year, a fine of not more than $2,000.00, or both.

This bill amends the penalty
for a conviction under this law by eliminating the minimum mandatory sentence
and increasing the maximum sentence to not more than 10 years. The potential
fine for a conviction under this law remains unchanged.

AN ACT relating to motor vehicles; increasing the penalty for a first conviction of driving under the influence of alcohol or a controlled substance resulting in serious bodily injury as specified; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Driving or having control of vehicle while under influence of intoxicating liquor or controlled substances; penalties.

(h)

As used in this subsection, "serious bodily injury" means bodily injury which creates a reasonable likelihood of death or which causes miscarriage or serious permanent disfigurement or protracted loss or impairment of any bodily member or organ. Whoever causes serious bodily injury to another person resulting from the violation of this section shall be punished upon conviction as follows:

(i)

If not subject to the penalty under paragraph (ii) of this subsection, by a fine of not less than two thousand dollars ($2,000.00) nor more than five thousand dollars ($5,000.00), imprisonment for not
less than six (6) months nor
more than
one (1) year
ten (10) years
, or both;

Section 2.

This act is effective July 1, 2007.
