AN ACT relating to public health and safety; authorizing the department of health to regulate tattoo parlors and the administration of body art as specified; granting rulemaking authority; providing for enforcement; and providing for an effective date.

240(a) by creating a new paragraph (xxii) is amended to read:

Powers and duties.

(a)

The department of health, through the state health officer, or under his direction and supervision, through the other employees of the department, shall have and exercise the following powers and duties:

To regulate tattoo parlors and the administration of tattoos or other body art, as defined in W.S. 14

107(c)(i), for purposes of preventing the spread of disease. If the director has probable cause to believe that an imminent hazard to the public health exists from a violation of regulations adopted pursuant to this paragraph, he may order any person to immediately cease the practice believed to be a violation and shall provide the person an opportunity for a hearing pursuant to the Wyoming Administrative Procedure Act within ten (10) days after issuing the order. The director may also apply to the district court for an order enjoining a violation of regulations adopted pursuant to this paragraph.

Section 2.

This act is effective July 1, 2007.
