Summary/Major Elements: The act defines special municipal officers as municipal employees whose duties include animal control, parking and municipal code enforcement. The act allows special municipal officers to issue citations for enforcement of animal control, parking and municipal code violations. The act specifies that special municipal officers are not law enforcement officers for purposes of employee benefits, titles 6 and 7 and governmental immunity statutes. The act specifies that a special municipal officer does not have the power of arrest, shall not be issued a badge or firearm, and shall not represent himself as a peace officer.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0079 ENROLLED ACT NO. 25, SENATE FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to cities and towns; authorizing cities and towns to appoint special municipal officers who are not certified as peace officers; authorizing special municipal officers to issue citations to persons as specified; conforming provisions; providing limitations; providing a definition; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 7 ‑ 2 ‑ 103 by creating a new subsection (e) and 15 ‑ 1 ‑ 103(a) by creating a new paragraph (l) is amended to read: 7 ‑ 2 ‑ 103. Issuance of citations. (e) For purposes of this section, "issuing officer" means a peace officer, or a special municipal officer acting in accordance with the terms of his appointment under W.S. 15 ‑ 1 ‑ 103(a)(l). A "special municipal officer" means a municipal employee whose duties include the areas of animal control, parking or municipal code enforcement. 15 ‑ 1 ‑ 103. General powers of governing bodies. (a) The governing bodies of all cities and towns may: (l) Appoint special municipal officers, who are not certified as peace officers, to issue citations to individuals for the limited purpose of enforcing ordinances, resolutions and regulations in the areas of animal control, parking and municipal code enforcement. Special municipal officers are not law enforcement officers: (A) For purposes of employee benefits provided in title 9 of Wyoming statutes; (B) Are not peace officers for purposes of title 6 or title 7 of Wyoming statutes; (C) Are not peace officers for purposes of W.S. 1 ‑ 39 ‑ 112 ; (D) Shall not be required to carry a firearm; (E) Shall not have the power of arrest; (F) Shall not be issued a peace officer's badge; and (G) Shall not represent themselves to be peace officers. Section 2. This act is effective July 1, 2007.
