Sponsored by: Senator(s) Cooper and Representative(s) Davison A BILL for AN ACT relating to highways; increasing funds required in the industrial road program account; increasing percentage of severance tax distributed to the highway fund; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 24 ‑ 5 ‑ 118 and 39 ‑ 14 ‑ 801 (e)(i) and (iv) are amended to read: 24 ‑ 5 ‑ 118. Industrial road program account. The transportation commission shall set aside and appropriate out of funds in their possession or under their control, not otherwise appropriated, the sum of four million dollars ($4,000,000.00) eight million dollars ($ 8 ,000,000.00) at the beginning of each biennium to be placed in an account known as the industrial road program account within the highway fund. All funds not used during each biennium shall lapse and be returned to the general account of the highway fund. 39 ‑ 14 ‑ 801. Severance tax distributions; distribution account created; formula. (e) Deposits into the account created by subsection (a) of this section shall be distributed as follows, subject to subsections (b) through (d) of this section: (i) To the general fund, sixty-two and twenty-six hundredths percent (62.26%) sixty and ninety-sixth hundredths percent ( 60 .9 6 %) ; (iv) To the highway fund, four and thirty-three hundredths percent (4.33%) five and sixty-three hundredths percent ( 5.63 %) , except that if the total unencumbered revenues within the state park road account created by W.S. 24 ‑ 14 ‑ 102 are less than five hundred thousand dollars ($500,000.00) on July 1, 2001 or on July 1 of any even-numbered year thereafter, the state treasurer shall first distribute revenues to that account in an amount equal to five hundred thousand dollars ($500,000.00) less the total unencumbered revenues in the account on July 1 of that year; Section 2.
