years;

Under this bill, a district
is allowed to submit facility plan modifications to the School Facilities
Commission once each year;

Requires Commission to
consult with affected school districts regarding facility plans and to provide
districts the opportunity to informally review facility plans and building
projects prior to formal administrative review through independent hearings;

Clarifies Commission
authority regarding major school building projects by: (1) requiring Commission
approval of building design and planning documents; and (2) requiring the
Commission to enforce schematic design documents, value engineering analysis,
energy efficient assessments and safety and security assessments pertaining to
any proposed building project.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

School district facility plans; filing with commission; commission review; administrative review.

(b)

In accordance with

a schedule

established by the commission, district facility plans required under this section shall be submitted to the commission not later than July 1 of each odd numbered year. Districts may submit and the commission shall
, once each year,
accept and review facility plans at dates earlier than those prescribed in the schedule. Plans shall be in a form and subject to guidelines prescribed by commission rule and regulation.

(f)

In carrying out this act and in accordance with policies adopted by the commission, the commission shall consult with the affected school districts and shall provide districts the opportunity to informally review facility plans, remedies and projects with the commission before districts pursue administrative review under subsection (e) of this section.

Building and facility construction and renovation projects.

(a)

Upon determination by the commission following review under W.S. 21

117, and appropriation by the legislature in accordance with W.S. 21
‑

‑
119, the commission shall proceed with projects authorized and approved by the legislature as follows:

(ii)

If a major capital outlay remedy:

(A)

With the assistance of the involved school district, develop
and approve
the necessary schematic design documents;

(E)

Waive any of

the requirements under subparagraphs (a)(ii)(B) through (D) of this section
and may waive any of these requirements
if determined not necessary or if provided within any one (1) of the other requirements specified under this paragraph.

This act is effective July 1, 2007.
