Subject: Establishes new criminal offense. Summary/Major Elements: This act: Establishes a new criminal offense, the elements of which are: o Willful killing of a pregnant woman; o Knowing that the woman is pregnant; o Causing involuntary termination of the pregnancy without a live birth. Specifies that the newly established crime is separate and distinct from the homicide of the pregnant woman; Specifies a prison term for the new crime of 20 years to life in prison. NOTE: This bill was vetoed by the Governor on March 9, 2007. The veto message provided in part that the Act would put Wyoming squarely in the middle of the abortion debate. The message further stated that Wyoming law already contains many protections for pregnant women. The Governor's action was taken after the bill summary was initially prepared and this summary should replace the summary in the bound materials.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0118 ENROLLED ACT NO. 73, SENATE FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2007 GENERAL SESSION AN ACT relating to homicide; establishing the offense of homicide of a pregnant woman resulting in the involuntary termination of the pregnancy without a live birth; imposing a penalty; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 6 ‑ 2 ‑ 109 is created to read: 6 ‑ 2 ‑ 109. Homicide of a pregnant woman resulting in the involuntary termination of the pregnancy without a live birth; Whoever willfully kills any pregnant woman knowing that the woman is pregnant, and thereby causes the involuntary termination of the woman's pregnancy without a live birth, is guilty of homicide, separate and distinct from the homicide of the pregnant woman, and shall be imprisoned in the penitentiary for any term not less than twenty (20) years and not more than life. Section 2. This act is effective July 1, 2007.
