A BILL

for

AN ACT relating to trade and commerce; providing for a study by the attorney general of pricing of motor vehicle fuels; providing for assistance by other state agencies; providing for a report; and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

The attorney general shall study the pricing of gasoline and other motor vehicle fuels within the state of
Wyoming
at both the wholesale and retail levels. The study shall include:

(i)

An analysis of current pricing of those fuels and historical pricing within the past five (5) years, statewide and by regions within Wyoming, to include five
(5)
geographic regions, being the northeast, northwest, southeast, southwest and central with the exact division established by the attorney general as he determines best for purposes of the study;

(ii)

A comparison for the same period of overall motor vehicle fuel prices at the retail and wholesale levels in Wyoming, with each state bordering Wyoming, and with the entire United States;

(iii)

An analysis of how wholesale and retail motor vehicle fuel prices are set in Wyoming and whether the results of the study give any indication of unlawful, unjust, collusive or predatory price manipulation in Wyoming; and

(iv)

An analysis of current
Wyoming
law providing for restrictions or prohibitions on unlawful, unjust, collusive or predatory manipulation of motor vehicle fuel prices.

(b)

All state agencies, including the
University
of
Wyoming
, shall cooperate with and assist the attorney general as requested in performing the duties required under this act.

(c)

The attorney general shall report the results of the study to the joint judiciary interim committee by November 1, 2007. The report shall include any recommendations for statutory changes to prohibit or restrict unjust, collusive or predatory manipulation of motor vehicle fuel prices and to authorize investigations and actions by the attorney general or other law enforcement officials to enforce those prohibitions or restrictions.

(d)

T
he joint judiciary interim committee shall review the report and may sponsor legislation to implement any recommendations or other legislation it deems beneficial to ensure that

citizens are assured fair pricing of motor vehicle fuels in the state.
