Transportation funding task force.

A BILL

for

AN ACT relating to transportation; creating a joint legislative-executive task force to review issues related to long term funding for highway construction and maintenance; specifying membership and duties of the task force; specifying scope of the review; requiring a report; providing appropriations; and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

There is created a transportation funding task force consisting of thirteen (13) members, including:

(i)

The director of the department of transportation;

(ii)

The chairman of the transportation commission;

(iii)

The state treasurer;

(i

Six (6) members appointed by the governor, as follows:

(A)

Three (3) members from the highway construction industry;

(B)

One (1) member from the hospitality industry;

(C)

One (1) member from the oil and gas industry;

(D)

One (1) member from the mining industry.

(v)

Four (4) members of the legislature, including the chairs of the house and senate transportation, highway and military affairs committees, one (1) senator appointed by the president of the senate and one (1) representative appointed by the speaker of the house.

(b)

Members of the task force shall select a chairman and a vice chairman.

(c)

The task force shall meet at the call of the chairman and shall convene its first meeting no later than May 1, 2007. The task force shall review and evaluate current and long term funding methods for state highway construction and maintenance.

(d)

The task force shall issue a final report to the governor and joint appropriations interim committee no later than June 1, 2008, which shall include:

(i)

A summary of current highway funding and a review of state and federal statutes and regulations related to highway funding;

(ii)

Options and recommendations for the department of transportation to enhance the effectiveness of current highway funding;

(iii)

Options and recommendations to increase highway funding using current or new sources of revenue.

(e)

The task force shall be staffed by the governor's office. The task force may contract for administrative and research services to aid in preparation of the task force report.

(f)

The task force shall exist until March 15, 2009.

(g)

Members of the task force shall be paid as follows:

(i)

Legislative members of the committee shall be paid salary, per diem and travel expenses as provided in W.S. 28

101 for their official duties as members of the committee;

(ii)

State employees serving on the task force shall receive no additional compensation for serving on the task force, but shall be paid as provided in W.S. 9

103 for travel and per diem expenses incurred for their official duties as members of the task force;

(iii)

All other members of the task force shall not receive a salary but shall be paid as provided in W.S. 9

Section 2.

(a)

There is appropriated from the general fund to the governor's office two hundred forty thousand dollars ($240,000.00), effective immediately, for purposes of this act.

(b)

There is appropriated from the general fund to the legislative service office ten thousand dollars ($10,000.00), effective immediately, to the legislative service office to fund the salaries, per diem and travel expenses of the state legislative members of the task force pursuant to section 1 of this act.

(c)

Any unexpended or unobligated funds from the appropriations in this section remaining at the end of the biennium on June 30, 2008 shall not lapse and shall not revert as provided in W.S. 9

207.
Any unencumbered, unexpended and unobligated amounts appropriated under this section shall revert to the general fund on June 30, 2009.
