State budget; requests by recipients of certain earmarked funds for additional funding from the budget reserve account.

(b)

The total amount available for
the purpose of

distribution to state agencies pursuant to subsections (a), (d) and (f) of
this section shall be the estimated deposits into the budget reserve account for the next biennial budget period under W.S. 9

601(d)(iv) and 39

801(d)(ii).

(d)

The governor shall include his recommendations for additional funding for state agencies
and for local governments
from the budget reserve account in his December 1 budget recommendation to the legislature. His total recommendations under this section shall not exceed the total amount determined under subsection (b) of this section.

(h)

On or before December 1 of the year preceding the year the legislature convenes a budget session, the governor shall include in his biennial budget recommendations an appropriation for local governments and the fund from which the appropriation shall be made. The total amount to be recommended for local governments under this subsection shall
not be less than the amount to
be computed according to the following formula:

(i)

Using the latest available consensus revenue estimating group revenue projections, add estimates of severance taxes to be distributed under W.S. 39

801(b) and (d)(i) and (ii) to estimates of federal mineral royalties to be distributed under W.S. 9
‑
4
‑
601(d) for the next biennial budget period beginning on July 1 of the ensuing year. Of this amount, multiply:

(A)

The first two hundred fifty million dollars ($250,000,000.00) by five percent (5%);

(B)

The amount between two hundred fifty million dollars ($250,000,000.00) and five hundred million dollars ($500,000,000.00) by ten percent (10%); and

(C)

Any amount above five hundred million dollars ($500,000,000.00) by fifteen percent (15%)
.

(ii)

The total amount to be recommended under this subsection for local governments shall be the sum of subparagraphs (i)(A), (B) and (C) of this subsection.

This act is effective July 1, 2007.
