Taking certain game animals without license or during a closed season prohibited.

(a)

Any person who takes any elk or moose without the proper license is guilty of a
4th
third
degree misdemeanor.

(b)

Any person who takes any bighorn sheep, mountain goat, mountain lion, grizzly bear or, gray wolf where classified as a trophy game animal, without the proper license except as otherwise permitted by this act is guilty of a
4th
second
degree misdemeanor.

(b)

Violation of this section constitutes a
fifth
second
degree misdemeanor.

Fines and sentences.

(a)

Any person who has been convicted of or pleaded guilty to any offense under this act may be fined, sentenced to the county jail, or both, as follows:

(i)

Up to
two thousand dollars ($2,000.00)
ten thousand dollars ($10,000.00)
to which may be added imprisonment up to one (1) year when the offense is a 1st degree misdemeanor;

(ii)

Up to
one thousand dollars ($1,000.00)
five thousand dollars ($5,000.00)
to which may be added imprisonment up to one (1) year when the offense is a 2nd degree misdemeanor;

(iii)

Up to
six hundred dollars ($600.00)
two thousand dollars ($2,000.00)
to which may be added imprisonment up to one (1) year when the offense is a 3rd degree misdemeanor;

(iv)

Not less than two hundred dollars ($200.00) nor more than
seven hundred fifty dollars ($750.00)
one thousand dollars ($1,000.00)
to which may be added imprisonment up to six (6) months when the offense is a 4th degree misdemeanor;

Section 2.

This act is effective July 1, 2007.
