Sponsored by: Senate Labor, Health and Social Services Committee A BILL for AN ACT relating to crimes and offenses; providing an increased penalty for aggravated assault against a pregnant woman which results in termination of the pregnancy; providing such an act is an aggravating circumstance for the imposition of the death penalty in homicide cases as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 6 ‑ 2 ‑ 102(h) by creating a new paragraph (xiii) and 6 ‑ 2 ‑ 502(b) are amended to read: 6 ‑ 2 ‑ 102. Presentence hearing for murder in the first degree; mitigating and aggravating circumstances; effect of error in hearing. (h) Aggravating circumstances are limited to the following: (xiii) The defendant killed a pregnant woman resulting in a termination of the pregnancy without a live birth and the defendant was the biological father of the unborn embryo or fetus. 6 ‑ 2 ‑ 502. Aggravated assault and battery; penalty . (b) Except as otherwise provided in this subsection, a ggravated assault and battery is a felony punishable by imprisonment for not more than ten (10) years. Aggravated assault and battery under paragraph (a)(iv) of this section is a felony punishable by imprisonment for not less than ten (10) years and not more than twenty (20) years, if the act of the defendant resulted in the termination of the pregnancy without a live birth. Section 2 . This act is effective July 1, 2007. (END) 1 SF0157
