WORKING DRAFT 2007 STATE OF WYOMING 07LSO-0492 SENATE FILE NO. SF0168 Public works apprenticeships. Sponsored by: Senator(s) Hastert and Representative(s) Blake, Craft, Goggles and Zwonitzer, Dn. A BILL for AN ACT relating to public works and contracts; increasing the public works bid preference for use of apprentices on public works projects as specified; requiring the sharing of bid preference proceeds among contractors and subcontractors as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 16 ‑ 6 ‑ 902(a) is amended to read: 16 ‑ 6 ‑ 902. Apprentices to be used on public works projects; waiver; report. (a) For all public works awarded by the state, the University of Wyoming, a community college or a school district pursuant to W.S. 16 ‑ 6 ‑ 101 through 16 ‑ 6 ‑ 206 estimated to cost one million dollars ($1,000,000.00) or more, a contractor who commits to ensure that not less than ten percent (10%) of the labor hours shall be worked by apprentices shall have his bid considered as if his bid were one percent (1%) five percent (5%) lower than the actual dollar value of his bid. The contractor awarded a contract under this section, after consideration of all other applicable preferences under this chapter, shall be awarded the contract at the actual dollar value of his bid under this section. The contract shall require that the proceeds of the preference be shared pro rata among the contractor and subcontractors in proportion to the wages paid respectively to apprentice employees of the contractor and subcontractors. This subsection shall not apply to those state agencies that have a recognized or approved apprenticeship training program requirement by the United States department of labor or other appropriate federally funded program. Section 2 . This act is effective July 1, 2007. (END) 1 SF0168
