Summary/Major Elements:

Allows a matter required to
be supported by a sworn statement of the person making it to be supported or
proven by the person certifying in writing "under penalty of false swearing"
that the matter is true. The certification must also state the date and place
of execution.

This self-certifying
mechanism cannot be used to verify, declare or certify:

o

A deposition;

o

An acknowledgment;

o

An oath of office;

o

Or an oath required to be
taken before a specified official other than a notary public.

A person who makes a false
certification under this new section is guilty of false swearing under W.S.
6-5-303(c), a felony punishable by imprisonment for not more than 2 years, a
fine of not more than $2,000 or both.

Certification of documents.

(a)

A matter required or authorized to be supported, evidenced, established or proven by the sworn statement, declaration, verification, certificate, oath or affidavit, in writing of the person making it, other than a deposition, an acknowledgment, an oath of office or an oath required to be taken before a specified official other than a notary public, may be supported, evidenced, established or proven by the person certifying in writing "under penalty of false swearing" that the matter is true. The certification shall state the date and place of execution and the following:

"I certify under penalty of false swearing that the foregoing is true".

(b)

A person who knowingly makes a false certification under subsection (a) of this section is guilty of false swearing in violation of W.S. 6
