WORKING DRAFT 2007 STATE OF WYOMING 07LSO-0667 SENATE FILE NO. SF0174 Eminent domain-public use. Sponsored by: Senator(s) Job, Geis and Vasey and Representative(s) Semlek A BILL for AN ACT relating to eminent domain; defining public use; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 1 ‑ 26 ‑ 502(a) by creating a new paragraph (vi) and by renumbering (vi) as (vii) is amended to read: 1 ‑ 26 ‑ 502. Definitions. (a) As used in this act: (vi) "Public use" means: (A) The possession, occupation and enjoyment of the land by the general public or by public agencies; (B) The use of land for creation or functioning of public utilities or rural electric cooperatives for domestic distribution; or (C) The use of eminent domain to : (I) Eliminate a direct threat to public health or safety caused by the property in its current condition; and (II) Remove a public nuisance; or (II I) R e move a structure that is beyond repair or is unfit for human habitation or use; or (I V ) Acquire abandoned property . (vi) (vii) "This act" means W.S. 1 ‑ 26 ‑ 501 through 1 ‑ 26 ‑ 817. Section 2. This act is effective July 1, 2007. (END) 1 SF0174
