Sponsored by: Senator(s) Barrasso and Perkins and Representative(s) Walsh A BILL for AN ACT relating to licensing and operation of health care facilities; providing requirements for specialty hospitals licensure; providing a definition; granting rulemaking authority; providing for exceptions; providing for emergency procedures; amending licensing requirements; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 35 ‑ 2 ‑ 913 is created to read: 35 ‑ 2 ‑ 913. Specialty hospitals; requirements for licensure. (a) To be licensed under this chapter a specialty hospital shall: (i) Comply, except as provided in this section, with all standards, rules and regulations adopted by the department for hospitals; (ii) If a specialty hospital does not provide emergency services it shall: (A) Establish procedures to stabilize a patient with an emergency medical condition until the patient is transported or transferred to another hospital if emergency services cannot be provided to meet the needs of the patient in an emergency; (B) Enter into a transfer agreement with any other community hospital for patients not covered under the Emergency Medical Treatment and Labor Act, whose condition develops into an emergency beyond the capability of the specialty hospital. (iii) If a specialty hospital does provide emergency services it shall participate in the Wyoming Emergency Medical and Trauma System as a hospital with specialized capabilities. (b) To be licensed under this chapter, specialty hospitals shall not be required to: (i) Admit patients with diagnoses and conditions that extend beyond its capability of services; (ii) Act as an access point for care for patients in nonurgent cases; (iii) Admit patients for general medical conditions; (iv) Act as first responders during disasters; (v) Be primarily engaged in inpatient care as required by the center for Medicare and Medicaid s ervices for hospitals. Section 2. W.S. 35 ‑ 2 ‑ 901(a) by creating a new paragraph (xxiv) and by amending and renumbering (xxiv) as (xxv) and 35 ‑ 2 ‑ 904(a)(intro) are amended to read: 35 ‑ 2 ‑ 901. Definitions; applicability of provisions. (a) As used in this act: (xxiv) "Specialty hospital" means a licensed hospital, organized or incorporated as an entity which permits stays of twenty-four (24) hours or more and is primarily or exclusively engaged in the care and treatment of one (1) or more of the following: (A) Patients with a cardiac condition; (B) Patients with an orthopedic condition; (C) Patients receiving a surgical procedure; and (D) Any other specialized category of services as designated by the department, but shall not include: (I) Psychiatric hospitals; (II) Rehabilitation hospitals; (III) Children's hospitals; (IV) Long-term care hospitals; and (V) Cancer treatment hospitals. (xxiv) (xv) "This act" means W.S. 35 ‑ 2 ‑ 901 through 35 ‑ 2 ‑ 912 35 ‑ 2 ‑ 913 . 35 ‑ 2 ‑ 904. Issuance of license; fee; duration; renewal; transferability; provisional licenses; procedures. (a) The division shall review each application to determine the appropriate category of license to issue under this act. The division shall issue a the appropriate license under this act: Section 3. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion. (END) 1 SF0178
