WORKING DRAFT 2008 STATE OF WYOMING 08LSO-0144 HOUSE BILL NO. HB0053 Garnishees' administrative fees. Sponsored by: Representative(s) Dockstader A BILL for AN ACT relating to garnishment of wages; authorizing an employer garnishee to deduct a fee for processing the writ of garnishment as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 1 ‑ 15 ‑ 408 by creating a new subsection (d) and 1 ‑ 15 ‑ 506 by creating a new subsection (e) are amended to read: 1 ‑ 15 ‑ 408. Garnishment of earnings for personal services. (d ) From income due the judgment debtor, the garnishee may withhold and retain an administrative fee of ten dollars ($10.00) for each pay period for which income is withheld. The administrative fee shall be in addition to the amount required to be withheld under the writ of garnishment. If the addition of this fee causes the total amount withheld to exceed the restrictions imposed by subsection (b) of this section, the fee shall be deducted from the amount withheld. 1 ‑ 15 ‑ 506. Service of notice upon judgment debtor; answer and tender of payment by garnishee. (e ) From income due the judgment debtor, the garnishee may withhold and retain an administrative fee of ten dollars ($10.00) for each pay period for which income is withheld. The administrative fee shall be in addition to the amount required to be withheld under the writ of continuing garnishment. If the addition of this fee causes the total amount withheld to exceed the restrictions imposed by W.S. 1 ‑ 15 ‑ 511, the fee shall be deducted from the amount withheld. Section 2.
