Subject: Law allowing the state auditor to conduct employee criminal background checks. Summary/Major Elements: Allows Division of Criminal Investigation to disseminate criminal history records of State Auditor's employees and employee applicants who have access to confidential financial or accounting records. The act also allows the State Auditor to obtain financial information of an employee of the State Auditor or employee applicant.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0064 ENROLLED ACT NO. 7, HOUSE OF REPRESENTATIVES FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2008 BUDGET SESSION AN ACT relating to the state auditor; authorizing the state auditor to obtain financial and criminal background checks as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 7 ‑ 19 ‑ 106(a) by creating a new paragraph (xix), 7 ‑ 19 ‑ 201(a) by creating a new paragraph (xii) and 9 ‑ 1 ‑ 403 by creating a new subsection (h) are amended to read: 7 ‑ 19 ‑ 106. Access to, and dissemination of, information. (a) Criminal history record information shall be disseminated by criminal justice agencies in this state, whether directly or through any intermediary, only to: (xix) The state auditor. 7 ‑ 19 ‑ 201. State or national criminal history record information. (a) The following persons shall be required to submit to fingerprinting in order to obtain state and national criminal history record information: (xii) State auditor employees or applicants for employment who have access to confidential financial or accounting records . 9 ‑ 1 ‑ 403. State auditor; duties; prohibited acts; powers; investigative subpoenas. (h) The state auditor shall have the authority to obtain the financial and criminal background of an employee or employment applicant of the state auditor in accordance with W.S. 7 ‑ 19 ‑ 106 and 7 ‑ 19 ‑ 201. Section 2. This act is effective July 1, 2008.
