A BILL

for

AN ACT relating to emergency detention costs; limiting authority to seek recovery of costs from patients as specified; and providing for an effective date.

Liability for costs of detention, involuntary hospitalization and proceedings therefor.

(d)

The hospital or other treatment provider shall attempt to recover all costs of treatment from public and private health insurance
first

then
from patients, and from government benefit programs prior to seeking payment from the county or the department.
If the patient has been diagnosed as actually or potentially seriously and persistently mentally ill
and the patient's income is at or below two hundred percent (200%) of the federal poverty level
, the hospital or other treatment provider shall limit its treatment cost recovery attempts with the patient to not more than three

(3) contacts with the patient.

Section 2.
This act is effective July 1, 2008.
