Summary/Major Elements: Current law provides for governmental bodies empowered to hold an interest in real property in Wyoming or the United States to hold a conservation easement. This act: Prohibits the Wyoming Board of Land Commissioners from accepting conservation easements after the effective date of this act. Excludes the Wyoming Board of Land Commissioners from being a governmental body empowered to hold a conservation easement, except for conservation easements already held as of the effective date of this act.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0111 ENROLLED ACT NO. 15, HOUSE OF REPRESENTATIVES FIFTY-NINTH LEGISLATURE OF THE STATE OF WYOMING 2008 BUDGET SESSION AN ACT relating to state lands; prohibiting the board of land commissioners from accepting conservation easements; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 36 ‑ 1 ‑ 121 is created to read: 36 ‑ 1 ‑ 121. Conservation easements. (a) Except for any conservation easement received or accepted by the board before the effective date of this act , the board shall not accept or receive any conservation easement pursuant to W.S. 34 ‑ 1 ‑ 202. (b) Except for any conservation easement received or accepted by the board before the effective date of this act , the board shall not be considered a "holder" pursuant to W.S. 34 ‑ 1 ‑ 201(b)(ii)(A). Section 2. W.S. 34 ‑ 1 ‑ 201(b)(ii)(A) is amended to read: 34 ‑ 1 ‑ 201. Short title; definitions. (b) As used in this article, unless the context requires otherwise: (ii) "Holder" means: (A) A governmental body empowered to hold an interest in real property under the laws of this state or the United States but does not include the Wyoming board of land commissioners after the effective date of this act ; or Section 3. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion.
