Powers and duties of the commission.

(a)

The commission shall perform the following general functions:

(ii)

Establish tuition rates for the community colleges
;

subject to the following:

(A)

Tuition for a student who is not a resident of Wyoming shall
be
established at a rate
at least
three hundred thirty percent (330%)
greater than the rate set for a resident student, except as may be provided by reciprocal agreement with a college or other post secondary education institution located out-of-state;

(B)

Tuition for a student who is not a resident of the community college district
of the college of attendance shall be established at a rate at least thirty percent (30%) greater than the rate set for a student resident of the community college district.

(a)

The community college district board may:
