WORKING DRAFT 2008 STATE OF WYOMING 08LSO-0373 HOUSE BILL NO. HB0139 Reduction of state government through attrition . Sponsored by: Representative(s) Zwonitzer, Dn., Berger, Cohee, Miller, Semlek, Shepperson, Teeters and Wallis and Senator(s) Aullman and Von Flatern A BILL for AN ACT relating to administration of government; requiring state agencies to reduce the number of positions when employees are lost through attrition as specified ; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 9 ‑ 2 ‑ 1011 by creating a new subsection (d) is amended to read: 9 ‑ 2 ‑ 1011. Duties of budget division; preparation of standard budget estimates; entities to prepare expanded and exception budgets; form; required information; base budgets. (d) During the period July 1, 2008 through June 30, 2012, in any agency with a total of sixty (60) or more authorized full or part-time permanent positions, if any permanent position becomes vacant the agency shall eliminate that position or a corresponding full or part-time position until two percent ( 2 %) of the agency's authorized permanent positions as of July 1, 2008 have been eliminated. No position eliminated pursuant to this subsection shall appear in the agency's standard or exception budget requests for any period until after July 30, 2012 . Position elimination pursuant to this subsection shall not require layoffs due to reduction in force as defined in W.S. 9 ‑ 3 ‑ 105(a) and funds appropriated for such positions shall not revert . For purposes of this subsection "agency" means any executive branch agency excluding the U niversity of Wyoming and community colleges. Section 2 . This act is effective July 1, 2008. (END) 1 HB0139
