WORKING DRAFT 2008 STATE OF WYOMING 08LSO-0382 HOUSE BILL NO. HB0149 Unfilled position elimination. Sponsored by: Representative(s) Wallis and Mercer A BILL for AN ACT relating to state government; providing for the elimination of positions in state governmental entities which remain unfilled as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1 . W.S. 9 ‑ 2 ‑ 1011 by creating a new subsection (d) is amended to read: 9 ‑ 2 ‑ 1011. Duties of budget division; preparation of standard budget estimates; entities to prepare expanded and exception budgets; form; required information; base budgets. (d) A ny full or part - time permanent position in any state governmental entity which has been vacant for a period of twenty-four (24) consecutive months is eliminated on the first day of the calendar month following which the position has been vacant for twenty-four (24) consecutive months. All funds appropriated for such positions shall revert to the fund from which the appropriation was made. No position eliminated pursuant to this section shall appear in a state governmental entity's standard or exception budget request during the biennium in which the position is eliminated or in the subsequent biennium. For purposes of this subsection "state governmental entity" means any executive branch agency, state court, legislative service office, the University of Wyoming and community colleges. Section 2 . For purposes of this act the period of vacancy prior to the effective date of this act shall be included in computing the twenty-four (24) month vacancy period. Section 3. This act is effective July 1, 2008. (END) 1 HB0149
