AN ACT relating to victim restitution; providing restitution for loss of support as specified; providing definitions; and providing for an effective date.

101.

Definitions.

(a)

As used in this chapter:

(iii)

"Pecuniary damage" means all damages which a victim could recover against the defendant in a civil action arising out of the same facts or event, including damages for wrongful death. It does not include punitive damages and damages for pain, suffering, mental anguish and loss of consortium
. In cases in which the
defendant's
criminal activity constitutes domestic abuse, "pecuniary damage" include

damages for loss of support as defined in paragraph (viii)

f this subsection

"Domestic abuse" means as defined by W.S. 35

(vii)

"Household member" means as defined by W.S. 35

(viii)

"Loss of support" means costs incurred

as a direct or indirect result of the defendant's criminal activity
,
for the transportation and temporary housing of the victim and other household members, child care expenses and the loss of the defendant's income to the household.

Section 2.
This act is effective July 1, 2008.
