WORKING DRAFT 2008 STATE OF WYOMING 08LSO-0385 HOUSE JOINT RESOLUTION NO. HJ0011 Prohibition on transfer taxes. Sponsored by: Representative(s) Madden, Esquibel, K . and Miller and Senator(s) Bebout, Hastert and Meier A BILL for A JOINT RESOLUTION proposing to amend the Wyoming Constitution by prohibiting any tax upon the transfer of title to or an interest in real property. BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING , two-thirds of all the members of the two houses, voting separately, concurring therein: Section 1. The following proposal to amend Wyoming Constitution, Article 15 , Section 13 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election: Article 15, Section 13. Tax must be authorized by law; law to state object. No tax shall be levied, except in pursuance of law, and every law imposing a tax shall state distinctly the object of the same, to which only it shall be applied. No tax shall be levied upon the transfer of title to or an interest in real property. Section 2. That the Secretary of State shall endorse the following statement on the proposed amendment: The adoption of th is amendment would prohibit the state of Wyoming and local governments from imposing taxes on the sale or transfer of title to or an interest in real property.
