Summary/Major Elements:

Under current law, for the
first 72 hours during which a person is detained or in which involuntary
commitment proceedings are brought, the county (and the state, upon the
expiration of the county's responsibilities) is required to pay for medical
costs for conditions that require immediate medical attention.

This act:

o

Limits the payment of costs incurred
to those conditions that resulted in the emergency detention of the person or
are attributable to affirmative actions taken by the person that have placed
the person in danger of suicide or serious bodily harm and require immediate medical
attention;

o

o

Specifies that
"costs" shall not include expenses for any medical procedures that
are not related to the assessment of, or necessary treatment for, the suspected
mental illness, except as otherwise specified in this act.

AN ACT relating to hospitalization of mentally ill persons; limiting the costs that a county or the state may be required to pay for persons detained to determine whether the person is mentally ill and in need of involuntary hospitalization; and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

112(a)(i) and by creating a new subsection (f) is amended to read:

Liability for costs of detention, involuntary hospitalization and proceedings therefor.

(a)

Subject to the provisions of subsections (d) and (e) of this section, the county in which a person is detained or in which involuntary hospitalization proceedings are brought shall pay the costs of:

(i)

The first seventy-two (72) hours of detention, in addition to any Saturday, Sunday or legal holiday that falls within the seventy-two (72) hours, pursuant to W.S. 25-10-109, including costs of medical treatment for those conditions

demanding

(A)

That resulted in the emergency detention of the person; or

(B)

That are attributable to affirmative actions taken by the person that

have placed the person in danger of suicide or serious bodily harm and require
immediate medical attention

(f)

For purposes of this section, "costs" shall not include the expenses for any medical procedures that are not:

(i)

Related to the
assessment of or necessary
treatment for the suspected mental illness; or

(ii)

Otherwise specified in paragraph (a)(i) of this section.

Section 2.

This act is effective July 1, 2008.
